Legal Notice to School for Fee Refund Format
A school fee refund notice is a written demand asking a school to return admission fees, advance fees or charges that were collected unfairly, usually after a withdrawal or transfer. It cites the school’s own fee terms, the Right to Education Act where capitation is involved, and State fee rules. Start by writing to the principal and the education department.
When to send this notice
Use this notice when a school keeps fees after you withdrew the child before the session, refuses to return caution money or advance fees, charged fees that the State rules or the school’s prospectus do not allow, or took a capitation fee for admission. First check the fee policy in the prospectus or admission form you signed, because refund rights often depend on it.
Statutory basis
Fee refunds from a school are governed mainly by the contract in the admission form and prospectus, the education laws and fee-regulation rules of the State or Union Territory, and the board’s affiliation rules. Under the Indian Contract Act, 1872, a clause that forfeits money on withdrawal is enforceable only to the extent of reasonable compensation, not more than the amount named (Section 74), and a party can claim damages for breach (Section 73). Section 13 of the Right of Children to Free and Compulsory Education Act, 2009 bars any school from collecting a capitation fee or subjecting a child or parent to a screening procedure at admission, and the Supreme Court held in T.M.A. Pai Foundation v. State of Karnataka (2002) that capitation fees are impermissible. Many States regulate what fees schools may charge through specific Acts, rules or education department orders, and complaints can go to the Director of Education or the fee regulatory committee, where one exists. The Supreme Court has held that educational institutions are not service providers under the Consumer Protection Act for their core educational functions (Maharshi Dayanand University v. Surjeet Kaur, 2010; P.T. Koshy v. Ellen Charitable Trust, 2012), so a consumer complaint against a school may not be accepted. A civil suit for recovery of money is generally filed within three years.

How to send this legal notice
From draft to proof of delivery and the next legal step.
Gather the admission form, prospectus, fee receipts, fee circulars and your withdrawal or transfer application.
Read the school’s refund and withdrawal policy and check any State fee-regulation rules that apply to your school.
Send a written refund request to the principal first and keep an acknowledged copy.
Draft the notice listing each payment, the basis for refund and a deadline, with a copy to the education department.
Serve it by Registered Post A/D and email, and file a complaint with the Directorate or District Education Officer if there is no response.
If the money is still not refunded, consider a civil suit for recovery, or a complaint to the fee regulatory committee where one exists.
Frequently asked questions
Can a school refuse to refund fees after the child leaves?
A school may keep a reasonable amount if its published policy and the law allow, but it cannot retain more than that or keep sums such as caution money or illegal capitation fees. The contract terms and the State rules decide how much is refundable.
Is capitation fee for school admission legal?
No. Section 13 of the Right to Education Act, 2009 prohibits schools from collecting capitation fees at admission, and the Supreme Court has also held that capitation fees are not permitted.
Can I go to the consumer commission against a school?
It is uncertain. The Supreme Court has said that educational institutions are not service providers for their core educational functions, so such complaints are often rejected. A complaint to the education department or a civil suit is the safer route.
