Does a rent agreement need to be registered in India?

Last reviewed

Depends
Short answer

A lease of immovable property from year to year, for more than one year, or reserving a yearly rent must be registered under Section 17 of the Registration Act, 1908. That is why many rent agreements run for 11 months. Some states go further — Maharashtra, for example, requires leave and licence agreements to be registered regardless of term.

The law this relies on

Registration Act, 1908

Section 17(1)(d)

Compulsory registration of leases from year to year, exceeding one year, or reserving a yearly rent.

Registration Act, 1908

Section 49

Effect of non-registration; collateral-purpose use only.

Transfer of Property Act, 1882

Section 107

Leases of a year or more, or reserving yearly rent, only by registered instrument.

Maharashtra Rent Control Act, 1999

Section 55

Leave and licence/tenancy agreements in Maharashtra must be in writing and registered.

Explained

What does the law require?

Section 17(1)(d) of the Registration Act, 1908 makes registration compulsory for leases of immovable property from year to year, for any term exceeding one year, or reserving a yearly rent. Section 107 of the Transfer of Property Act, 1882 adds that such leases can be made only by a registered instrument. Shorter leases may be made orally or by an unregistered agreement, though they still need stamping.

Why are rent agreements usually 11 months?

An 11-month agreement sits below the one-year threshold, so it can be signed on stamp paper without visiting the Sub-Registrar and paying registration fees. It is a common practice, not a legal requirement. Renewals every 11 months create fresh agreements, and a long run of renewals does not by itself convert the arrangement into a registrable lease.

Are there state-specific rules?

Yes. Under Section 55 of the Maharashtra Rent Control Act, 1999, leave and licence and tenancy agreements must be in writing and registered whatever their term, and the state offers online registration. States that have adopted a law modelled on the Model Tenancy Act, 2021 may also require tenancies to be reported to a Rent Authority. Check the rules of the state where the property sits.

What happens if a registrable lease is not registered?

Under Section 49 of the Registration Act, an unregistered document that should have been registered does not create the lease and cannot be received as evidence of the transaction affecting the property. It can still be used for collateral purposes, such as proving the nature of possession. In practice, the tenancy may be treated as month-to-month, which weakens long lock-in or rent-escalation terms.

Frequently asked questions

Is an 11-month rent agreement legal?

Yes. An agreement for less than one year does not need compulsory registration under the Registration Act in most states, but it must be properly stamped. Maharashtra is a key exception where registration is required anyway.

Is a notarised rent agreement enough?

Notarisation only attests signatures; it is not registration. For a lease that must be registered, notarisation does not cure the lack of registration.

Does a rent agreement need stamp duty?

Yes. Leases are chargeable under the state stamp law, usually as a percentage of rent and deposit or a fixed amount for short terms. Duty should be paid before signing.

Can a landlord evict without a registered agreement?

Eviction is governed by the state rent law and the Transfer of Property Act, not just the agreement. An unregistered agreement can still help prove the tenancy for collateral purposes.
