How this draft is built

The generator assembles a standard residential rent / leave-and-licence agreement structure — parties, description of the premises, term and lock-in, rent and security deposit clauses, maintenance and utility responsibilities, the tenant's/licensee's obligations, termination and notice conditions, governing law, and a signature block with witnesses — using the details you enter above. In many states, especially Maharashtra, this kind of agreement is drafted as a leave-and-licence (not a lease) to avoid tenancy protections, and is typically registered and e-stamped.

  • Rent, deposit and dates are inserted directly into the clauses below.
  • Lock-in period is stated as a minimum term during which neither party can terminate without cause.
  • Registration, stamp duty and notarisation requirements vary by state and are not computed by this tool.

Sources & legal basis

  • Transfer of Property Act, 1882 — Chapter V (leases of immovable property).
  • Registration Act, 1908 — registration requirements for leases exceeding one year.
  • Indian Stamp Act, 1899 and state stamp-duty legislation (e.g. Maharashtra Rent Control Act, 1999 for leave-and-licence arrangements).
  • State-specific Rent Control / Tenancy Acts and Model Tenancy Act 2021 (where adopted by a state).

Registration, stamp duty and notice-period rules differ by state. Treat this draft as a starting point and have it reviewed, stamped and registered as required in your jurisdiction.
