Legal Notice for Illegal Construction Format
An illegal construction notice is a written demand asking the owner or builder to stop and undo building work that has no sanction, departs from the approved plan or encroaches on your land or a common area. A copy goes to the municipal or planning authority asking it to act. If both ignore it, you can seek an injunction from the civil court.
When to send this notice
Use this notice when a neighbour or builder is constructing without a sanctioned plan, adding floors or structures beyond the approval, building on your boundary or on common property, or blocking light, air or access. Collect proof first, because courts and authorities act on the plan, photographs and site facts. For noise, smoke or similar disturbance, use the nuisance notice instead.
Statutory basis
India has no single national law on unauthorised construction. Building plans, permissions, stop-work and demolition powers sit in State municipal and town-planning laws, such as municipal corporation Acts and development authority Acts, and in the local building rules and zoning regulations made under them. These laws generally require a sanctioned plan before construction and allow the authority to issue a stop-work notice and, after hearing the owner, to demolish. A private person affected by the construction can complain to the municipal commissioner or planning authority. Civil courts can restrain the owner by a perpetual injunction under Section 38 of the Specific Relief Act, 1963, order removal of the structure by a mandatory injunction under Section 39, and grant a temporary injunction under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure, 1908. A suit for possession or injunction lies for encroachment on your own land. If the authority fails to act on a complaint, a writ petition under Article 226 of the Constitution can seek a direction to act in accordance with law. Where the work is in a RERA-registered project, Section 14 of the Real Estate (Regulation and Development) Act, 2016 limits changes to sanctioned plans without the allottees’ consent. Some municipal Acts require prior notice before suing the corporation, so check the local Act first.

Frequently asked questions
Who can complain about illegal construction?
Any affected person can complain to the municipal or planning authority, and an owner whose property or rights are affected can also sue for an injunction. The authority has the power to stop and remove unauthorised work under the local law.
Can I get illegal construction demolished through a court?
A civil court can order removal of a structure through a mandatory injunction in a suit between private parties, and the municipal authority can order demolition after following its own law. Courts usually look at the sanctioned plan and the extent of deviation.
Is a legal notice needed before going to the municipal corporation?
No. You can complain to the authority directly at any time. A notice to the owner is useful as proof that you objected early, which matters when you later ask a court for an urgent injunction.
