Legal Notice for Partition of Property Format

A partition notice is a written request from a co-owner or coparcener asking the others to divide jointly held property and hand over a separate share to the sender, ideally by agreement. No law requires it before a partition suit, but it records your claim, stops alienation and often leads to a family settlement without going to court.

When to send this notice

Use this notice when ancestral, inherited or jointly bought property is still undivided and the other co-owners refuse to divide it, are exploiting it alone, or are selling or mortgaging it. It is also useful when you are being kept out of possession. Shares depend on how the property came to the family and on the personal law of the parties, so state your basis of title clearly.

Statutory basis

There is no single statute that requires a partition notice. A co-owner’s right to seek partition rests on general property law and on personal and succession laws. Under Section 6 of the Hindu Succession Act, 1956, as substituted in 2005, a daughter of a coparcener is a coparcener by birth with the same rights and liabilities as a son, and the Supreme Court held in Vineeta Sharma v. Rakesh Sharma (2020) that this applies whether or not the father was alive on 9 September 2005. Where a person dies without a will, heirs take their shares under the applicable succession law. If parties do not agree, a partition suit in a civil court ends in a preliminary decree declaring shares and a final decree dividing the property by metes and bounds (Order XX Rule 18 of the Code of Civil Procedure, 1908). Under the Partition Act, 1893, the court can order a sale and division of proceeds when a fair physical division is not possible (Section 2), and a family member may buy out an outsider who purchases a co-owner’s share in an undivided dwelling house (Section 4). A written partition deed for immovable property must be registered under Section 17 of the Registration Act, 1908 and stamped under the State stamp law. Division of agricultural land is usually handled by revenue authorities under State land revenue law.

Subject: Notice for partition and separate possession of the property described in the Schedule.

Sir/Madam,

Under instructions from my client, [Name], of [Address] ("my client"), I serve upon you the following notice:

1. That the property described in the Schedule below (the "said property") was [acquired by late (Name) on (date) by (purchase / inheritance / gift) / jointly purchased by the parties on (date) vide sale deed no. (___)] and is held jointly by my client and you.

2. That the parties are related as follows: [state the relationship chart and how my client’s share arises, e.g. son/daughter/legal heir of late (Name)]. My client is entitled to an undivided [__] share in the said property.

3. That the said property has not been partitioned by metes and bounds. [Despite repeated requests, you have refused to partition it / you are in exclusive possession and have excluded my client / you have attempted to sell or mortgage it.]

4. That my client wishes to separate the share and calls upon you to partition the said property by mutual agreement and to execute a registered partition deed.

I therefore call upon you, within thirty (30) days of receipt of this notice, to (a) meet and agree on partition, or confirm in writing your willingness to partition, (b) refrain from selling, mortgaging, gifting or creating any third-party right in the said property, and (c) account for the rents and income from it. Failing this, my client shall file a suit for partition and separate possession, with accounts and injunction, at your risk, cost, and consequences.

How to send this legal notice

From draft to proof of delivery and the next legal step.

  1. Collect the title documents: sale deed, will or succession certificate, family tree, revenue records and tax receipts.

  2. Work out the nature of the property (ancestral, self-acquired, jointly purchased) and each person’s share under the applicable law.

  3. List every co-owner and heir, since all necessary parties will have to be included in any later suit.

  4. Draft the notice with the Schedule of property, your share and a clear demand to partition and not to alienate.

  5. Serve each co-owner by Registered Post A/D and email, and keep proof of delivery.

  6. If there is no agreement, sign a registered partition deed or file a partition suit before the civil court (or the revenue authority for agricultural land).

Frequently asked questions

Is a legal notice compulsory before filing a partition suit?

No. A notice is not a legal condition for a partition suit between private co-owners. It is still worth sending because it proves that you demanded partition and puts the others on notice not to sell or deal with the property.

Do daughters have a share in ancestral property?

Under Section 6 of the Hindu Succession Act, 1956 as amended in 2005, a daughter is a coparcener by birth in Hindu joint family property with the same rights as a son. Shares for other communities depend on their personal law.

Can co-owners sell their share before partition?

A co-owner may usually transfer their own undivided share, but not the whole property or a specific portion without the others. A notice asking co-owners not to alienate helps you challenge a sale that affects your share.
