Legal Notice to Employer for Wrongful Termination Format
A wrongful termination notice challenges an employer’s decision to end your employment without the notice, pay, enquiry or retrenchment compensation the law or your contract requires. It demands reinstatement or compensation and your full dues within a stated period, usually 15 days, before you raise an industrial dispute or file a civil suit.
When to send this notice
Use this notice when you were dismissed or asked to resign without notice or notice pay, without a fair domestic enquiry for alleged misconduct, in breach of the termination clause, or in retaliation for a complaint (for example under the POSH law). Whether you can seek reinstatement or only damages depends on whether you are a “workman” under labour law or a managerial or supervisory employee governed mainly by contract.
Statutory basis
For employees who qualify as “workmen”, retrenchment requires prior notice (or pay in lieu) and retrenchment compensation of 15 days’ average pay for each completed year — historically under Section 25F of the Industrial Disputes Act, 1947, now carried into the Industrial Relations Code, 2020, which the Central Government brought into force in November 2025; disputes are raised before the conciliation machinery and Industrial Tribunal. Dismissal for misconduct generally requires a fair enquiry under the applicable standing orders. Managerial employees usually have a contractual remedy: damages for the notice period and unpaid dues under the Indian Contract Act, 1872. State Shops and Establishments Acts may also require notice or pay in lieu, and gratuity is payable after five years’ continuous service under the gratuity law.

Frequently asked questions
Can my employer terminate me without notice?
Only if your contract allows it with pay in lieu of notice, or in cases of proven misconduct after due process. Otherwise you are usually entitled to the notice period or salary for it.
Can I get my job back after wrongful termination?
Reinstatement is mainly available to workmen through the industrial dispute machinery. Managerial employees generally get damages for the notice period and dues, not reinstatement.
Is gratuity payable if I was terminated?
Generally yes, if you completed the qualifying continuous service; forfeiture is allowed only in narrow cases of proven misconduct such as causing damage or acts of moral turpitude.
