Legal Notice for Insurance Claim Rejection Format

An insurance claim rejection notice demands that an insurer reconsider and pay a claim it has wrongly repudiated, short-settled or delayed, giving reasons why the rejection is unsustainable. It is usually sent after an internal grievance, and before approaching the Insurance Ombudsman or a Consumer Commission for deficiency in service under the Consumer Protection Act, 2019.

When to send this notice

Use this notice when your health, life, motor, travel or property claim has been rejected on grounds such as alleged non-disclosure, pre-existing disease, policy exclusions or delayed intimation that you believe do not apply, or when the insurer has not decided the claim within a reasonable time. Read the policy wording and the rejection letter carefully first — the reply should meet each ground.

Statutory basis

Insurance is a “service” under the Consumer Protection Act, 2019, so wrongful repudiation can be challenged before the District, State or National Commission depending on the claim value, generally within two years of the cause of action. Section 45 of the Insurance Act, 1938 bars an insurer from calling a life policy in question on any ground after three years from the policy date or revival. IRDAI regulations on protection of policyholders’ interests prescribe claim-settlement timelines and require reasons for repudiation. Policyholders can also complain to the Insurance Ombudsman under the Insurance Ombudsman Rules, 2017 after first approaching the insurer, within monetary limits.

How to send this legal notice

From draft to proof of delivery and the next legal step.

  1. Obtain the full policy wording, proposal form, claim documents and the written rejection letter.

  2. Meet each ground of rejection with documents — medical records, disclosures, surveyor reports.

  3. Lodge a written grievance with the insurer’s grievance officer if not already done.

  4. Send the legal notice by Registered Post A/D and email to the grievance officer and claims head.

  5. If unresolved, complain to the Insurance Ombudsman (within its limits) or file a consumer complaint.

Frequently asked questions

Can I go to the Insurance Ombudsman and the consumer court?

You generally choose one forum for the same grievance. The Ombudsman is free and faster for claims within its limit; Consumer Commissions can award compensation and costs and have no low cap.

Can an insurer reject a claim for non-disclosure years later?

For life insurance, Section 45 of the Insurance Act bars questioning the policy on any ground after three years from issue or revival. For other policies, the non-disclosure must be material to the risk.

Is a legal notice required before a consumer complaint?

Not strictly, but it is useful to show that the insurer was given a chance to correct the deficiency, and it frames the issues for the complaint.
