Legal Notice to Bank for Deficiency in Service Format
A legal notice to a bank for deficiency in service demands that it reverse an unauthorised debit, refund wrongful charges, release documents, correct a credit record or otherwise fix a service failure, with compensation, within a stated time. Banking is a service under the Consumer Protection Act, 2019, and the RBI Integrated Ombudsman Scheme offers a parallel remedy.
When to send this notice
Use this notice when a bank has failed to act on your complaint about unauthorised electronic transactions, failed ATM or UPI debits not reversed, charges not in its published schedule, non-return of property documents after loan closure, wrongful dishonour of your cheque, or incorrect credit reporting. Always lodge a written complaint with the bank first and keep the reference number.
Statutory basis
Banking falls within “service” under the Consumer Protection Act, 2019, so deficiency can be challenged before the Consumer Commission within two years of the cause of action. Under the RBI Integrated Ombudsman Scheme, 2021 you may complain to the RBI Ombudsman if the bank rejects your complaint or does not reply within 30 days, generally within one year of the bank’s reply. RBI’s customer-protection directions limit customer liability for unauthorised electronic transactions reported promptly, and RBI directions require lenders to return original property documents within a fixed period after loan closure, with compensation for delay. Credit-information disputes are also governed by the Credit Information Companies (Regulation) Act, 2005.

Will the bank refund money lost in online fraud?
RBI directions limit customer liability for unauthorised electronic transactions, with zero or limited liability if you report quickly and were not negligent. Report immediately — delay increases your share of the loss.
When can I complain to the RBI Ombudsman?
After first complaining to the bank, if it rejects the complaint, gives an unsatisfactory reply, or does not reply within 30 days. The complaint is filed online and is free.
Can I claim compensation for delay in returning property papers?
RBI directions require lenders to release original documents within a set period after full repayment and to compensate the borrower for delay. Cite the closure date and your requests in the notice.
